By accessing or using the Site, placing an order, creating an account, or otherwise engaging with our services, you agree to be bound by these Terms and all policies incorporated by reference. If you do not agree, do not use the Site.
1. Eligibility & Age Restriction
The Site is intended for use by individuals 21 years of age or older. By using the Site, you represent and warrant that you are at least 21.
Products containing hemp-derived cannabinoids may be subject to state and local laws that vary by jurisdiction and may change over time. You are responsible for confirming that the purchase, possession, and use of such products is lawful in your location before ordering.

Prices, promotions, discounts, and availability may change at any time and may differ between online channels, retail locations, and third-party platforms. We are not responsible for pricing or promotional discrepancies on third-party marketplaces.

6. Payments & Security
Payments are processed through secure, third-party payment processors using industry-standard encryption and tokenization. We do not store full payment card information on our servers.
Payment processing is subject to the terms and privacy practices of the applicable payment provider.
7. Subscriptions & Recurring Billing
Certain products available through the Site may be offered on a recurring subscription basis (“Subscriptions”).
By enrolling in a Subscription, you authorize Americanna Wellness, Inc. to automatically charge your selected payment method at the price and delivery frequency disclosed at checkout, plus any applicable taxes, until you cancel your Subscription.
Your Subscription will automatically renew according to the delivery schedule you select unless it is paused or cancelled. The applicable subscription price, billing frequency, delivery frequency, and other material terms will be presented to you before you complete your purchase.
You may cancel your Subscription at any time through My Account → Subscriptions. Once cancelled, no future Subscription renewals will be charged. Cancellation applies to future renewals only and does not automatically cancel or refund an order that has already been charged or processed.

By enrolling in a Subscription, you also agree to our Subscription Terms, Shipping Policy, and Refund Policy, each of which is incorporated into these Terms of Use by reference.
If there is a conflict between these Terms of Use and the Subscription Terms regarding a Subscription-specific matter, the Subscription Terms will control.
8. Accounts & User Responsibilities
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current, and complete information.
We reserve the right to suspend or terminate accounts for violations of these Terms or misuse of the Site.
9. Wholesale & Reseller Accounts
Wholesale, reseller, and provider relationships are governed by separate agreements, including registration requirements and clickwrap acceptance within our partner portal.

Use of the consumer Site does not grant wholesale or reseller rights.
10. Affiliate Programs
Participation in any affiliate or referral program is governed by separate Affiliate Terms, which apply only upon enrollment and acceptance:

Affiliate participation is not automatic and is subject to approval and program-specific conditions.
11. Intellectual Property
All content on the Site, including text, images, graphics, logos, videos, product names, and trademarks, is owned by or licensed to Americanna Wellness, Inc. and protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, or exploit any Site content without prior written consent.
12. User Content
If you submit reviews, comments, images, videos, or other content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display such content for business, marketing, and promotional purposes, unless prohibited by law.
13. Prohibited Conduct

- Interfere with Site functionality or security
- Attempt to gain unauthorized access to systems or accounts
- Misrepresent your identity or affiliation
We reserve the right to investigate and take appropriate action for violations.

15. Limitation of Liability

17. Governing Law & Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in state or federal courts located in Washington.

We may update these Terms at any time. Changes will be effective upon posting. Continued use of the Site constitutes acceptance of the revised Terms.
